P-2020-001 Public Order City Parking Lots and Pier Closure 2020-03-27PUBLIC ORDER NO. P-2020-001 A PUBLIC ORDER OF THE DIRECTOR OF EMERGENCY SERVICES OF THE CITY OF PISMO BEACH, CALIFORNIA RELATING TO CITY PARKING AND PIER REGULATIONS WHEREAS, Chapter 2.32 of the City of Pismo Beach Municipal Code provides that in the event of the proclamation of a state of emergency by the Governor, the city Director Of Emergency Services is empowered to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency, provided, however, such rules and regulations must be confirmed at the earliest practicable time by the City Council; and WHEREAS, the Director of Emergency Services of the City of Pismo Beach does hereby find: 1. That conditions of peril to the safety of persons and property have arisen within the City of Pismo Beach, due to the Novel Coronavirus (COVID-19); and 2. On March 4, 2020, the Governor of the State of California declared a state of emergency due to conditions caused by COVID-19; and 3. On March 13, 2020, the Director of Emergency Services for the County of San Luis Obispo declared a state of emergency due to conditions caused by COVID-19; and 4. On March 13, 2020, the President of the United States declared a state of emergency due to conditions caused by COVID-19; and 5. On March 16, 2020, the City Council of the City of Pismo Beach declared a state of emergency within the City of Pismo Beach due to conditions caused by COVID- 19; and 6. That due to members of the public failing to heed the "safer at home" requirements of the County of San Luis Obispo's Local Emergency Order and Regulation No. 4, parking in City parking lots and at City parking meters must be limited to one hour for those persons not working in businesses deemed essential under Section 11(c)(4) of the County's Order and Regulation No. 4; and 7. That the City Council of the City of Pismo Beach is not in session and cannot immediately be called into session. NOW, THEREFORE, IT IS HEREBY ORDERED by the Director of Emergency Services of the City of Pismo Beach as follows: During such times as they are otherwise open to the public, parking in the following City parking areas is limited to a maximum of one hour, unless the operator of the vehicle is engaged in work for an Essential Business as that term is used in Section 11(c)(4) of the County's Order and Regulation No. 4: PAGE 1 OF 2 P-2020-001 1. Pier parking lot 2. Addie Street parking lot 3. Pomeroy Street parking lot 4. Main Street parking lot 5. All metered parking spaces located in other areas. BE IT FURTHER ORDERED that City staff is directed to take such action as is deemed necessary to ensure posting of these restrictions at each of the above -referenced parking areas. BE IT FINALLY ORDERED that the City Pier shall be closed to the public until further order of the Di ector of Emergency Services or action of the City Council.
