R-2020-002 SEIU 2020-2022 MOU Side Letter Wasterwater Operator Certification Pay 2020-01-21RESOLUTION NO. R-2020-002 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PISMO BEACH, ' CALIFORNIA APPROVING A SIDE LETTER AGREEMENT TO THE MEMORANDUM OF UNDERSTANDING WITH THE SERVICE EMPLOYEES INTERNATIONAL UNION ("SEIU") FOR FISCAL YEARS 2020, 2021, AND 2022 WHEREAS, the Memorandum of Understanding is the collective bargaining agreement between the City of Pismo Beach and the SEIU; and WHEREAS, a Side Letter Agreement is proposed to address attraction and retention issues with the Wastewater classification series; and WHEREAS, the City Council believes that providing broadly competitive salaries and benefits retains and attracts quality employees to serve the Pismo Beach community including its residents, businesses and taxpayers. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Pismo Beach hereby approves the Side Letter Agreement which is attached hereto as Exhibit A. UPON MOTION OF Mayor Pro Tern Howell, seconded by Council Member Blake, the foregoing resolution was adopted by the City Council of the City of Pismo Beach this 21st day of January 2020, by the following vote: AYES: 5 Howell, Blake, Guthrie, Reiss, Waage NOES: 0 ABSENT: 0 ABSTAIN: 0 RECUSED: 0 Approved: Attest: Ed Waage, Mayor U Ind ,ity Clerk PAGE 1 OF 3 R-2020-002 1:117m:7fie1 SIDE LETTER AGREEMENT BETWEEN THE CITY OF PISMO BEACH, CALIFORNIA (HEREINAFTER CALLED "CITY") AND SERVICE EMPLOYEES INTERNATIONAL UNION AFL/CIO (SEIU), LOCAL 620 PISMO BEACH CITY EMPLOYEE'S CHAPTER (HEREINAFTER CALLED "UNION") WHEREAS, the City and Union have an existing Memorandum of Understanding from July 1, 2019 through June 30, 2022; and WHEREAS, the City has identified numerous recruitment and retention issues with the various Wastewater Operator classifications; and WHEREAS, the requirements of the classification require a commercial Class A driver's license with a hazmat endorsement to provide 24/7 response to the community; and WHEREAS, a singular adjustment of the compensation schedule for the Wastewater Operator classifications would create wage rate compaction and separation issues between classifications. NOW THEREFORE, City and Union hereby agree that: In an effort to attract more qualified Wastewater Operator candidates, to maintain the existing compensation structure and to avoid wage rate compaction and separation issues between classifications, the City and Union agree to modify the following section of the Memorandum of Understanding (MOU): ARTICLE 19 EXTRA COMPENSATION C.I. Certification Pav [the following paragraph to be added] "Employees assigned to Wastewater as Wastewater Operators, who obtain their commercial Class A driver's license with a hazmat endorsement shall be eligible to receive an additional certification pay of 2.5% of their base salary." The changes in the Side Letter Agreement shall only be valid during the existing MOU or the implementation of a compensation study, whichever occurs first. This Side Letter Agreement identifies those articles, sections, and subsections of the Memorandum of Understanding between the City and the Union that the parties have mutually agree to revise. All other terms of the Memorandum of Understanding remain in full force and effect.
